General Terms and Conditions (GTC)

§ 1 Scope of Application

  1. These General Terms and Conditions (hereinafter referred to as "GTC") of TriShare Capital AG (hereinafter referred to as "Seller"), apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter referred to as "Customer") concludes with the Seller regarding the goods displayed by the Seller in the online shop DreamPal.

  2. A consumer pursuant to these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

§ 2 Conclusion of Contract

  1. The product descriptions in the Seller's online shop do not constitute binding offers on the part of the Seller, but merely serve the purpose of submitting a binding offer by the Customer.

  2. The Customer can submit the offer via the online order form integrated into the Seller's online shop. By clicking the button finalizing the order process, the Customer submits a legally binding contract offer in relation to the goods contained in the shopping cart.

  3. The Seller may accept the Customer's offer within five days by sending a written order confirmation or an order confirmation in text form (fax or e-mail).

§ 3 Right of Withdrawal

  1. Consumers are generally entitled to a right of withdrawal.

  2. You have the right to withdraw from this contract within 14 days without giving any reason.

  3. To exercise the right of withdrawal, you must notify us (TriShare Capital AG, Sperlingsgasse 3, 49401 Damme, contact@dreampal.shop) of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or an e-mail).

§ 4 Prices and Payment Conditions

  1. Unless otherwise stated in the Seller's product description, the prices indicated are total prices that include the statutory sales tax (VAT).

  2. Payment options will be communicated to the Customer in the online shop.

§ 5 Shipment and Delivery Conditions

  1. Delivery of goods is made by mailing to the delivery address specified by the Customer.

  2. Shipping Costs:

    • The standard shipping fee is €4.99.

    • For orders with a cart value of €109.00 or more, shipping is free of charge.

  3. If the transport company returns the goods to the Seller because delivery to the Customer was not possible, the Customer bears the costs for the unsuccessful dispatch.

§ 6 Retention of Title

If the Seller provides advance performance, he retains title to the delivered goods until the purchase price owed has been paid in full.

§ 7 Liability for Defects (Warranty)

  1. If the purchased object is defective, statutory provisions apply.

  2. The Customer is asked to complain to the deliverer about delivered goods with obvious transport damages and to inform the Seller accordingly. If the Customer fails to do so, this shall have no effect on his statutory or contractual claims for defects.

§ 8 Applicable Law

The law of the Federal Republic of Germany shall apply to all legal relationships between the parties, excluding the laws on the international purchase of movable goods. For consumers, this choice of law only applies to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has his habitual residence.

§ 9 Alternative Dispute Resolution

The EU Commission provides a platform for online dispute resolution on the Internet at the following link: https://ec.europa.eu/consumers/odr. This platform serves as a contact point for the out-of-court settlement of disputes arising from online purchase or service contracts involving a consumer.

The Seller is neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.
